The petitioner/Union of India through the General Manager,

Northern Railways and Ors. has challenged the order dated 20th

January, 2009 passed in a batch of petitions which were filed by the

employees seeking quashing of memorandums of charges issued

against them and all the petitions were allowed by the Tribunal on the

ground that there has been inordinate delay in the holding of enquiry.

By the said impugned order dated 20th January, 2009, a batch of

petitions were decided including O.A No.1253/2008 titled Sh.Ram

Kishan v. Union of India and Ors against which a writ petition being

W.P(C) No.13894/2009 was filed by the petitioners challenging the

order dated 20th January, 2009. The said writ petition was dismissed by

this Court by order dated 23rd December, 2009 and the order of the

Tribunal dated 20th January, 2009 was upheld.

The present writ petition is filed against the same order dated 20th

January, 2009 passed in O.A No.1283/2008 titled Abid Ali v. Union of

India through General Manager Northern Railways and Ors.

Therefore, for the reasons stated in W.P(C) No.13894/2009

decided on 23rd December, 2009 titled Union of India and ors v. Sh.Ram

Kishan, the present writ petition is also dismissed as the petition has

no merit.
