                        JUDGMENT (Oral)

1. The appellant is present along with her counsel. The

respondent's counsel is also present.

2. It is stated by learned counsel for both the parties that

the parties have agreed to dissolve their marriage by mutual

consent and they shall file the joint petition for divorce by

mutual consent before the learned Trial Court along with an

application for waiving the statutory period of six months

within two weeks.

3. The appeal is disposed of in terms of the above

settlement with liberty to the appellant to approach this

Court for reopening of the case in the event of the

respondent not honouring his commitment. The learned Trial

Court shall dispose of the application for waiving the

statutory period of six months considering that the appellant

filed the petition for divorce before the learned Trial Court on

25th July, 2007 and the parties are in litigation since then and

there is no possibility of reconciliation between the parties.

4. Copy of this order be given 'Dasti' to learned counsel

for both the parties under signatures of the Court Master.
