Crl.M.C.No.2347/2008

The petitioner and respondent nos.2 and 3 are present and

learned counsel for the petitioner contends that the parties have settled

their disputes. Pursuant to settlement, an amount of Rs.25,000/- was

payable by the petitioner to respondent Nos.2 and 3 out of which

Rs.10,000/- was paid earlier and Rs.15,000/- has been paid in cash to

respondent Nos.2 today in the Court.

Let the statement of respondent No.3 be recorded, who is

identified by learned counsel for petitioner.

Statement of respondent No.3 has been recorded who states that

pursuant to settlement arrived at he does not want that proceedings

pursuant to FIR No.156/2007 under Sections 279/337 of IPC registered

at Police Station Tuglak Road be continued as no useful purpose shall

be served.

Considering the facts and in totality of circumstances, as no

useful purpose shall be served in continuing the proceedings pursuant

FIR No.156/2007 under Sections 279/337 of IPC registered at Police

Station Tuglak Road and it will also be in the interest of justice to

quash the FIR and all the proceedings emanating therefrom.

Consequently, the FIR No.156/2007 under Sections 279/337 of

IPC registered at Police Station Tuglak Road and all the proceedings

emanating therefrom are quashed.

The petition is disposed of with these directions. Dasti.
