This is an application under Section 439 of the Code of Criminal

Procedure for grant of interim bail to the petitioner on the ground that

she has to undergo surgery.

The petitioner had filed another application being Bail Application

No.1219/2008 seeking interim bail to undergo surgery in a private

hospital for removal of gallbladder stone. By order dated 10th June,

2008, the petitioner was granted interim bail for a period of one month

from the date of her release with the clarification that if the surgery for

gallbladder is not scheduled within two weeks of her release, she would

immediately surrender to the jail authorities. After the release of the

petitioner, surgery could not be scheduled within two weeks leading to

her surrender.

Now the present application is filed seeking her release on interim

bail on the ground that now she has to again undergo tests and

thereafter surgery for gallbladder which is to be performed on her in a

private hospital.

Considering the facts and circumstances and the medical reports

of the petitioner, she is granted interim bail for a period of four weeks

from the date of her release, subject to her furnishing a personal bond

in the sum of Rs.25,000/- with one surety of the like amount to the

satisfaction of the trial Court/Duty Magistrate.
