1. The petitioner is challenging the order dated 2.6.2006 whereby the petitioner who had received an appointment order to the post of Assistant Store Keeper was reverted to the post of Conductor. The ground for reversion is that the petitioner submitted a fake certificate of experience. This certificate of experience dated 1.10.1984 was found to be false inasmuch as the printed letter head with mobile numbers and seven digits telephone numbers would not have existed on the purported date of the certificate i.e. 1.10.1984. The respondent held a vigilance inquiry in which the vigilance inquiry discarded the experience certificate.

2. The petitioner admittedly filed a corrigendum to the experience certificate. The corrigendum is dated 10.11.2004. This corrigendum had been submitted before the vigilance report was obtained. However, the vigilance report before this Court at p.65 does not indicate that the corrigendum of 10.11.2004 has been taken note of. The vigilance report is certainly not complete without taking into consideration the corrigendum of 10.11.2004.

3. In this view of the matter, it will be appropriate that the vigilance department of the respondent takes into consideration the corrigendum dated 10.11.2004. Accordingly, the impugned order based on the vigilance report is set aside with liberty to the respondent to pass a fresh order after taking into consideration the vigilance report in respect of the experience certificate as well as the corrigendum dated 10.11.2004.

4. The writ petition is disposed of.
