JUDGMENT

A.K. Sikri, J.

1. By this petition, the petitioner has sought injunction order against the respondent from invoking/encashing the bank guarantees pursuant to the contract dated 8th August, 2002 between the parties for the operation and maintenance of two national highways NH-2 and NH-24. The petitioner was awarded another contract for operation and maintenance of national highways NH-8 vide contract dated 8th August, 2002. Similar dispute arose in respect of that contract as well and the petitioner filed two petitions relating to the two contracts; present petition i.e. OMP No. 422/2005 and OMP No. 421/2005 relating to the other contract.

2. Both the petitions were taken up together and arguments heard and the submissions made were common to both the cases. Vide separate judgment passed in OMP No. 421/2005 in today's date, I have dismissed the said petition as meritless. For the reasons stated therein, this petition also stands dismissed with cost quantified at Rs. 25,000/- Interim order dated 22nd November, 2005 also stands vacated.

3. A copy of the judgment passed in OMP No. 421/2005 shall be placed in this file as well.
