JUDGMENT

Manju Goel, J.

1. This Petition is preferred under Section 482, Cr.P.C., praying for setting aside of Order dated 6th December, 2004, passed by Shri Narinder Kumar, learned Metropolitan Magistrate, declining to give further opportunity to the petitioner to produce his witnesses. It is not disputed that the petitioner had obtained a relief from this Court for producing his witnesses and for this purpose two ....2...

2. :-opportunities, on his assurance that he would produce his witnesses on his own responsibility, was granted. Petitioner has availed of that benefit but has failed to produce his witnesses. He now wants one more opportunity. It is alleged on behalf of the respondent that the petitioner has been delaying the matter by making such applications only with that end in view. Petitioner cannot be granted the same relief over and over again. The prayer to this extent is therefore declined. However, the petitioner's prayer under Section 315, Cr.P.C. for his own appearance before the Court is allowed. Petitioner will be granted only one date for his appearance in the witness box. Parties shall appear before the Trial Court on 1st February, 2005. Miscellaneous Petition stands disposed of with this Order.
