ORDER

R.C. Jain, J.

1. The appeal of the appellant was admitted and his sentence was suspended uptil today on certain conditions vide an order dated 15.12.2004. The appellant stands convicted for the charge under Section 13(2) read with 13(1) of the Prevention of Corruption Act and has been sentenced to three years imprisonment and to pay a fine of Rs. 10,000/-. There is no immediate prospect of the appeal being disposed of.

2. Having regard to the totality of the facts and circumstances of the case and the material obtaining on record, the order dated 15.12.2004 is made absolute and the sentence of the appellant is suspended during the pendency of the appeal and he is ordered to be released on bail, subject to deposit of fine and executing a personal bond in the sum of Rs. 25,000/- with one surety in the like amount.

3. Needless to mention that the observations made herein will not tantamount to expression of any opinion on the merits of the appeal.

4. Application stands disposed of.

5. Appeal be listed for hearing in due course.

6. Copy dusty to Counsel for the appellant.
