K. Ramamoorthy, J.
1. The writ petitioner has filed this petition seeking to quash the chargesheet dated 01.10.1991 on the basis of delay. According to the petitioner there has been no justification in issuing chargesheet. The point raised in the writ petition is covered by the judgement of the Division Bench of this Court in CW No. 3145/94 and CW 5887/94 dated 01.05.1995 and following the judgement of the Supreme Court. This has also been followed by this court in D.P. Bambah Vs. Union of India & Ors. 1998 IV AD (Delhi) 240.
2. In view of the settled position, the writ petition stands allowed.
3. The chargesheet dated 01.10.1991 is quashed. The petitioner is entitled to be considered for promotion and other consequential benefits. There shall be no order as to costs.
