JUDGMENT

S. Ranganathan, J.

1. After hearing the counsel for the parties we think a question of law does arise out of the order of the Tribunal.

2. The Tribunal is directed to state a case and refer the following question of law for the decision of this Court : "Whether, on the facts and in the circumstances of the case the Tribunal is right in holding that the amounts of gifts of the joint family property made by the Karta of the joint family are not void but only voidable and that the same are not includible in the net wealth of the assessed family ?"

3. The applications are disposed of. No orders as to costs.
