Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 14.02.2023

1. The applicant has filed the instant criminal revision under Section 397 read with Section 401 of Cr.P.C. against the judgment dated 11.04.2014 passed by the Sessions Judge, Balod, District Balod (C.G.) in Criminal Appeal No. 8/2014 whereby affirming the judgment of conviction and order of sentence dated 13.02.2014 recorded by the learned Judicial Magistrate First Class, Dallirajhara, District Balod in Criminal Case. No. 308/2013 wherein the applicant has been convicted for commission of offence punishable under Section 379 read with Section 34 of IPC and sentenced to undergo R.I. for two years & fine of Rs.500/-, in default further S.I. for three months.

2. Learned counsel for the applicant would submit that during the pendency of this criminal revision, the applicant has died.

3. Learned counsel for the State endorses the submission made by learned counsel for the applicant.

4. Considering the fact that the applicant has died, the fact regarding pendency of the present criminal revision was well within the knowledge of family members of the applicant, but no application has been moved on behalf of the legal heirs of the applicant to prosecute this criminal revision, the present criminal revision stands abated and is disposed of as such.
