Heard.
1. As Mr. Ravindra Sharma, Advocate put in appearance on behalf of all the
respondents, therefore, fresh notice of acquittal appeal need not be
issued to them.
2. This is an application under Section 378(3) of the Code of Criminal
Procedure, 1973 for grant of leave to appeal.
3. Applicant State has preferred an acquittal appeal against the judgment
dated 24.01.2020 passed in Special Sessions Trial No.02/2019 by which
learned Special Judge (under POCSO Act, 2012) Janjgir, District-Janjgir
Champa, Chhattisgarh acquitted the respondent/accused from the
charges punishable under Sections 354 of the Indian Penal Code and
Section 8 of POCSO Act, 2012.
4. Perused the impugned judgment of the learned Court below, statement
of both the prosecutrix as well as other material available on record.
5. On due consideration, it appears that present is a fit case where leave
should be granted. CRMP is allowed. Leave to appeal is granted.
6. Registry is directed to register the CRMP as 'Acquittal Appeal' and list it after four weeks.
7. Accordingly, this CRMP is disposed off.
