1. This is an application filed under Section 378(3) of the Code of Criminal Procedure, 1973 for grant of leave to appeal against the judgment of acquittal dated 31.12.2018 passed in Criminal Case No.594/2016 by Judicial Magistrate First Class, Balod, District Balod (C.G.).
2. Heard on I.A. No.01, application for condonation of delay in filing the appeal.
3. On due consideration and for the reasons mentioned in the application, the same is allowed. Delay of 261 days in filing the appeal is condoned. Also heard on application for grant of leave to appeal.
4. I have perused the impugned judgment and gone through the statement of witnesses other material available on record.
5. On due consideration, the application is allowed and leave is granted. Registry is directed to register the present Cr.M.P. as acqittal appeal.
6. List this appeal after six weeks.
7. Accordingly, the Cr.M.P. stands disposed of.
