Learned counsel for appellants would submit that present
appellant is sarvarakar, therefore, he has Right to hold the property.
On the other hand, learned counsel for the respondent would
submit that the Co-ordinate Bench in Second Appeal No.51 of 2008 has
also examined the question of law framed in the present suit he would
further submit that both the suits arising out of same property and he
would refer the judgment of Co-ordinate Bench in Second Appeal No.51
of 2008 decided on 28.01.2020.
When this Court raised a specific query whether the Sarvarakar
has right to hold property then learned counsel for appellants would
submit that there is a judgment, for that he seeks a week's time.
List this case on 14.03.2022.
