Heard I.A. No.2 of 2022, an application under Section
100 (4) of C.P.C. for formulation of additional substantial
question of law.
Perused both the judgments of Trial Court as well as of
the Appellate Court. Also perused the substantial question
of law in the order dated 27.01.2014 of this Court. On due consideration and for the reasons mentioned
in the application, the same is allowed.
Substantial Question of Law No.2 is framed as under:
"Whether, the learned Courts below have justified
in holding that the suit of the plaintiffs is barred by
limitation?"
Also heard I.A. No.3 of 2022, an application under
Order 41 Rule 27 of C.P.C. for taking additional evidence on
record.
This application shall be considered at the time time of
final hearing of this appeal.
List this case for final hearing in the week commencing
25th July, 2022.
