By the impugned judgment dated 03/09/2019, passed by the learned Sessions Judge, District Janjgir Champa (C.G.) in Session Trial No. 34/2018, the Appellants stand convicted under Section 395/34 read with Section 397 of the IPC and Section 323/34 of the IPC and sentenced to undergo RI for 7 years with fine of Rs. 5,000/- and RI for 1 year with fine of Rs. 1,000 respectively, with default stipulations.
According to the Counsel Appellant No.1 has already completed more than 5 ½ years and Appellant Nos.2 & 3 have already completed more than 4 ½ years of jail sentence imposed upon them by the Trial Court.
Looking to the above submission of learned Counsel for the Appellants, learned Counsel for the State/Respondent is directed to call for a report from the concerned jail regarding detention period of the Appellants.
