Heard on application for grant of leave to appeal under Section 378(3) of
the Cr.P.C. against the judgment dated 28-08-2014 passed in Criminal Appeal
No.26/2014, whereby the learned Additional Sessions Judge, FTC, District
Korba , while reversing the judgment dated 22-07-2014 passed in Criminal Case
No.755 of 2013 by the Chief Judicial Magistrate, Korba, has acquitted the
respondents with regard to offence punishable under Section 4 of the Anaitik
Vyapar (Nivaran) Adhiniyam, 1956.
After perusal of the aforesaid judgment, I am inclined to allow this application.
Accordingly, the application is allowed and the appellant is hereby permitted to prefer an appeal against the aforesaid judgment dated 28-08-2014 passed by the learned Additional Sessions Judge, FTC, District Korba in Criminal Appeal No.26 of 2014.
Cr.M.P.No.1159 of 2015, thus, stands disposed of.
The Registry is directed to register the Regular Appeal under the head of Acquittal Appeal and post this matter for admission thereafter.
