1) The appeal i.e. CRA No.530 of 2020 and previously filed appeal CRA No.184 of 2020 are arising out of the same judgment of

conviction and order of sentence dated 23.12.2019 passed by the Additional Sessions Judge, F.T.S.C., (POCSO), Ambikapur, District Surguja, C.G. in Special Criminal Case (POCSO) No.48/2017. Previously filed appeal i.e. CRA No.184 of 2020 has been preferred by the same appellant namely Basant Singh through his counsel. Since two appeals against the same judgment of conviction and sentence are not maintainable, in the facts and circumstances of the case, the appeal i.e. CRA No. 530 of 2020 is dismissed as not maintainable.

2) List CRA No. 184 of 2020 for hearing in the month of December, 2021.

3) Meanwhile, State counsel is directed to file reply to the application I.A. No.01/2020, application for suspension of sentence and grant of bail to the appellant.
