Shri Sinha submits that the issue involved in this Appeal has already been clarified by the Allahabad High Court in the matter of Shailendra Tripathi and Another vs. Dharmendra Yadav and Others reported in SCC Online ALL 1360. He further submits that this Court has also settled the same issue, but at present, he is not having the copy of the judgment and therefore, prays for some time.
