Heard on I.A. No.01, an application for grant of interim relief.

It is submitted by learned counsel for the petitioners in all the cases that the present petitions have been brought challenging the notification dated 16.10.2020 and the Reorganization Scheme, 2019 for the Primary Agriculture Credit Cooperative Society. It is submitted that during the pendency of this petition, the State Cooperative Election Commission has issued the election program for the cooperative societies and the date of election has been fixed to be 04.12.2021.

It is submitted that petitioner in all the cases have been duly elected to their offices and the tenure of the societies have not come to an end. Annexure-P/5 the notification of the Chhattisgarh Ki Prathamik Krishi Saakh Sahkari Societiyon Ki Punargathan Yojna, 2019 is under challenge. This scheme was challenged in W.P. (C.) No. 3923/2019 and batch of other petition, which have been decided by the Division Bench of this Court by which the scheme Annexure-P/5 was struck off. It is submitted that as the societies have been reorganized on the basis of the scheme, therefore, the holding of the elections would certainly an infringement of the rights of the petitioners and against their interest.

Reliance has been placed on the judgment of Supreme Court in the case of Andhra Pradesh Dairy Development Corporation Federation Vs. B. Narsimha Reddy And Others reported in (2011) 9 Supreme Court Cases 286, in which it was held that the Extensive State control and ensuring operation of Cooperative principles cannot be done at the same time. Hence, the interim relief be granted by staying the election process.

Learned State counsel opposes the application and submits that the reorganisation as per the scheme of 2019 has already taken place, therefore, conducting election is necessary. It is further submitted that the reorganization was assailed before the Division Bench of this Court in which the prayer for interim relief was denied. Hence, the application may be rejected.

In reply, it is submitted that the registration of the new societies is itself illegal.

Heard learned counsel for both the parties and perused the documents present on record.

Considered on the submissions, as there is already an order of Division Bench in W.P. No.3031 of 2019 decided on 22.11.2019. Although the scheme has been modified as another scheme has been brought by notification dated 16.10.2020. For the election as proposed for the newly constituted societies can be kept in abeyance for some time.

Therefore, time is granted to the learned State counsel to file reply to this application for grant of interim relief.

In the meanwhile, it is ordered that the election process as notified by respondent authorities shall remain stayed until the next date of hearing.

List this case after four weeks.
