          Mr.   Sarosij   Dasgupta,   learned    Advocate   appearing   for   the

tenant/defendant No. 1 submits that the plea taken by his client seeking

dismissal of plaint on the ground that this eviction suit is not maintainable

as Commercial Suit.

          The issue is now pending before the Hon'ble Supreme Court in a

Special Leave Petition, which has been filed on December 5, 2025 and

registered as Diary No. 70360/2025.

          Mr.   Sarosij   Dasgupta,   learned    Advocate   appearing   for   the

defendant No. 1 submits that the suit pending before this Court has been

stayed by the Hon'ble Supreme Court upon SLP being admitted under an

order dated March 20, 2026.

          In view of the above, these series of applications are directed to go

out of the list for the time being.

          Parties, upon notice to each other, shall be at liberty to mention

matters after disposal of the issue pending before the Hon'ble Supreme

Court.

          The Department has detected that these series of applications are

not specially assigned and due to some mistaken recording, these are

showing as such in the cause list.

          Necessary corrections shall be made in the record of the proceeding

and henceforth, matters shall appear without bearing the remark "Specially

Assigned".
