1. The Court: When the 1st case is called out, learned Advocate(s) representing the
parties submit(s) that the appeal(s) involve a common issue.
2. The order(s) passed in the writ proceedings, in the matters other than
APOT/205/2025 and APOT/267/2025, are relying upon the decision passed in
WPO/33/2025.
3. There is, therefore, no dispute that the other matters are dependent upon the
decision of this Court in the appeal arising out of WPO/33/2025.
4. The issues being common and in view of the submissions recorded above, we
proceed to consider APOT/205/2025 along with APOT/267/2025 as a lead case.
5. After making some arguments being faced with the decision rendered by a larger
Bench of this Court in the case of Putul Rabidas -vs- Eastern Coalfields Ltd. &
Ors., reported in (2017) SCC OnLine Calcutta 13128 and its affirmation by the
Apex Court in SLP(Civil) Diary No.3590/2018, the learned Advocate for the
appellants in item no.5 APOT 205 of 2025, submits that before proceeding
further, he wants to take instructions from the appellants.
6. The matter is, therefore, adjourned for availing of such instructions.
7. The cases be listed on February 26, 2026 at 2 p.m.
