The Court: Mr. Gupta, learned Advocate for the decree-holder is
present.
Mr. Gupta, submits that in spite of granting two opportunities to file
affidavit of assets, the affidavit of assets is not filed. Learned Advocate prays
that the warrant of arrest be issued in accordance with Order XXI Rule 41(3)
of the Code of Civil Procedure.
Learned Advocate for the judgment-debtor submits that he is ready
and willing to file the affidavit of assets but his client is not resident of
Calcutta thus affidavit of assets could not be filed. However, in the interest of
justice, learned Advocate for the judgment-debtor is granted a last
opportunity to file affidavit of assets on or before 13th June, 2025.
Let this matter appear on 17th June, 2025.
This direction is peremptory and no further opportunity will be
granted.
The judgment-debtor shall not operate A/c with PAN No.
AAACR4139G without keeping a sum of Rs.3,16,49,902/-.
