AWARD

4. The learned advocate representing the appellant and the respondents would subrut that the claimants/respondents nave agreed to settle their claim subject to payment of Rs. 10,50,000/- {ten lakhs fifty thousand) only to be paid by the appellant to the claimants/respondents in full and final settlement of their claim which culminated in the judgment and award dated 26" June, 2023 passed by the Additional District War

and Sessions Judge, 1° Trial Court, 1 Diamondharbour, South 24 Pros. in MAC 282 of 2079.

2. The learned advocates appearing for the parties would submit that the entire awarded amount along with interest has already been deposited by the appellant with the learned Registrar General of this Court.

in view thereof, the learned Registrar General is directed to,

upon verifying the identity of the claimants/respondents to disburse the aforesaid amount of Rs. 10,50,000/- (ten lakhs fifty thousand) only in favour of the claimants/respondents in full and final settlement of their claim.

4, Upon disbursement of the aforesaid arnmount the remaining Ss amount, if any, lying ta the learned Registrar General shall be returned to the appellant, Insurance Company.

5. The appeal and the connected applications, if any, accordingly stands disposed of.

6. Let the Trial Court records, f called for, be sent down immediately.

7. The parties shall be entitled to a Photostat copy of this order free of charge.
