The Court :- Mr. Sarosij Dasgupta, learned Advocate for the decree holder
submits that the exparte decree passed in this suit was set aside on the
condition that the defendant shall deposit 75% of the decretal amount. By way of
a Special Leave Petition, the judgment debtor challenged the said order before the
Hon'ble Supreme Court. The said Special Leave Petition was dismissed and order
has been passed for depositing the aforesaid amount extending the time period of
two weeks. He files the copy of the order dated 13 th September, 2024 passed in
petition for special leave to appeal(c) nos. 20136-20137/2024.
Mr. Gaurab Kumar Das, learned Advocate appearing for the judgment
debtor submits that the application is premature one and is totally misconceived.
It is found from the order of the Hon'ble Supreme Court dated 13 th
September, 2024 that on the prayer made on behalf of the judgment debtor time
was extended for a period of two weeks to deposit the amount as directed.
Accordingly, list this matter on 30 th September, 2024.
