The learned advocate for the State is present.
The instant revisional application has been filed against the judgment
and order dated 16th April, 2010 passed by the learned Judicial
Magistrate, 1st Court, Tamluk in Misc. Case No. 375 of 2003 directed the
petitioner/husband to pay maintenance under Section 125 of the Code of
Criminal Procedure to the tune of Rs. 1500/ per month from the date of
passing of such order.
Perused the contentions of the petition as well as impugned order, the
marriage between the parties is not disputed and the opposite party
No.1/wife has been legally entitled to the maintenance claimed.
Perused the petition as well as the impugned order, this court does
not find any infirmity or impropriety in the impugned order. Accordingly,
this court is not inclined to interfere with the same.
Under such circumstances, the instant revisional application is
dismissed.
Copy of the order be communicated to the trial court for information.
