No one is present on behalf of the appellant. An application filed on 6 th day of September, 2023, after the passing of the judgment, being CAN 4 of 2023 is taken up.

The respondent is present in person. The respondent submits that the copy of the said application has been received by him. The respondent also submits that Supriya Chandra has expired on 24th day of August, 2023.

There is no dispute as regards to the death of Supriya Chandra on the 24th day of August, 2023. As the application has been filed after the delivery of the judgment so the name of Supriya Chandra is appearing in the judgment. As a judgment cannot be against a

dead person, so this application is taken up. As the legal heir of Supriya Chandra is already on record, that is Shri Suman Chandra, her son and there being no other legal heir, the name of Supriya Chandra be expunged from the judgment.

Department is directed to take steps accordingly.

Accordingly, CAN 4 of 2023 is disposed of.
