The Court: The present application has admittedly been filed after expiry

of the Arbitrator's mandate under Section 29-A of the1996 Act.

Learned counsel appearing for the respondent submits that the

application has been filed after a delay of 4½ years.

In view of a judgment delivered by this Court on 6th September, 2023 in

Rohan Builders (India) Private Limited v. Berger Paints India Limited, this Court

is of the view that the petitioner should be given one opportunity to have the

said judgment challenged before the appeal Court.

List this matter after three weeks, as prayed for.
