                                       Sri Srikanta Bakshi.

                                              ---------------

Mr. Uttiya Ray, Mr. Arnab Mondal.

... for the appellant.

Mr. Mohit Chatterjee.

... for the respondent.

Both the parties have filed their respective affidavit of assets and liabilities in terms of the judgment rendered by the Apex Court in Rajnesh vs. Neha, reported in (2021) 2 SCC 324.

The parties are at variance on the disclosure of the assets and liabilities, but at the time of hearing it appears that while passing a decree for dissolution of marriage, the permanent alimony to the tune of Rs. 5,00,000/- was awarded by the Tribunal. Though the appellant/wife has assailed the said decree for dissolution of marriage, but after taking into account the gamut of dispute, we feel that the parties can explore the possibility of amicable solution of the dispute through mediation.

Accordingly, the parties are directed to undergo mediation to sort out their disputes, if possible.

Let the order be placed before the Member Secretary, Mediation and Conciliation Committee, High Court, for the purpose of appointment of the Mediator in the instant case.

The Mediator shall undertake the process of mediation and submit the report before this Court within two months from the first sitting of the said mediation.

Both the Counsels appearing for the parties have assured this Court that their respective client appears

before the Mediator and efforts shall be made to resolve the disputes and shall not indulge in any kind of dilatory tactics to frustrate the process of mediation.

List the matter in the 1st week of December 2023.
