Mr. Habibur Rahaman, learned advocate appearing
on behalf of the appellant/petitioner has submitted
that appellant remained on bail all along during trial.
It is further submitted that he was only taken into
custody when he was found guilty.
2. Learned advocate appearing on behalf of the
appellant/petitioner has referred to the evidence.
3. In opposition to that, Mr. S. G. Mukherjee, learned
advocate appearing on behalf of the State has
referred to the evidence of victim girl.
4. I have perused the evidence and judgments
impugned.
5. Considering all facts and circumstances, specially
with regard to the term imprisonment as well as bail
granted in course of trial, I find no reason to disallow
the prayer for bail at this stage when there is hardly
any scope of the disposal for appeal within short
period of time.
6. Appellant be enlarged on bail subject to furnishing a
bond of Rs.30,000/- with two registered sureties of
Rs.15,000/- each, one of whom must be local, to the
satisfaction of the learned Chief Judicial Magistrate,
Barasat, North 24 Parganas and on further condition
that appellant shall attend the learned Trial Court
once in a fortnight and obtain acknowledgement of
attendance. In case of change of address appellant
shall inform the same to learned Chief Judicial
Magistrate, Barasat.
7. Accordingly CRAN 1 of 2023 stands disposed of.
