This appeal has been preferred against the judgment
and order of conviction dated 11th September, 2023
passed by the learned Additional Sessions Judge, 3rd
Court, Purba Bardhaman in connection with Sessions
Trial No.15 of 2019 corresponding to Sessions Case
No. 33 of 2019, thereby learned Judge found
appellants/convicts guilty of committing offence
under Section 304B/498A of the Indian Penal Code
and sentenced them to suffer rigorous imprisonment
for seven (07) years each for the offence punishable
under Section 304B of the Indian Penal Code and also
sentenced them to suffer rigorous imprisonment for
three (03) years for offence punishable under Section
498A of the Indian Penal Code with fine of Rs.5000/-
each, in default, to suffer further imprisonment for a
term of three months. Both the sentences were
ordered to run concurrently but in default of payment
of fine, the sentences were order to run consecutively.
2. Heard learned counsel appearing on behalf appellants
and also I have perused the judgment.
3. The appeal is admitted.
4. Issue usual notice.
5. Trial Court Record be called for.
6. After arrival of the Lower Court Record, if it is found,
otherwise in order, the formal paper book shall be
prepared within six weeks thereafter.
7. Liberty is given to file application for suspension of
sentence.
8. Realization of fine amount be stayed in the meantime.
