1. Affidavit-of-service filed in Court today be taken on

record.

2. This intra court appeal is directed against the

judgment and order dated 17 th August, 2023 passed

by the learned Single Judge of this Court.

3. By an impugned order, the learned Single Judge of

this Court only directed the respondent authorities to

reconsider the application of the private

respondent/writ petitioner for grant of Fair Price Shop

licence within a period of 60 days therefrom.

4. The appellant, who was the successful Fair Price

Shop Dealer, has come up in appeal before this Court

against the same.

5. This Court sees no serious prejudice to the

appellant or infirmity in the impugned order. The writ

petitioner/respondent's application is only to be

considered afresh. No serious prejudice is caused to

any side.

6. In that view of the matter, M.A.T. No. 1802 of 2023

shall stand disposed of without any orders.

7. Consequently, CAN 1 of 2023 shall also stand

disposed of without any orders.

8. There will be no order as to costs.

9. All parties are directed to act on a server copy of

this order duly downloaded from the official website of

this Court.
