1. CAN 8 of 2023 is filed by the respondent no. 5 wherein an additional ground is taken in support of the judgment delivered by the Trial Court. Certain averments have been made therein which, according to the appellant need to be dealt with.

Therefore, an opportunity should be given to file affidavit-in-opposition.

2. In view of the above, let affidavit-in-opposition to CAN 8 of 2023 be filed by the appellant by Friday i.e. 06.10.2023; an advance copy whereof shall be served upon the respondent no. 5. Reply, thereto, if any, be filed by Monday i.e. 09.10.2023.
