Affidavit-of-service filed in Court today is taken on record. Mr. Samamta, learned Advocate has started arguing the case but does not complete. He has cited three judgments.

Opposite party is also represented. At this juncture, it is however found necessary that the case record with respect to C.R. Case No. 358 of 2009 under Section 138 of the Negotiable Instruments Act, be called for, from the Court of Judicial Magistrate, 2nd Court at Tamluk.

Let the department do as necessary and incorporate the said record in this case.

In doing so, the department may keep in mind that since the appeal was preferred challenging the order of Magistrate in the said case, the case record may also be lying in the Court of Additional District and Sessions Judge, Fast Track, 2nd Court, Tamluk, Purba Mednipur.

Let the matter be adjourned today and again appear in the list on 17th April, 2023.
