The Court : The Hon'ble Supreme Court of India in terms of the
judgment passed in Civil Appeal No. 2277 of 2008 along with other
batches of appeals on 31st March, 2008 directed that the instant civil
suit be taken up for hearing only after dismissal of the probate
proceedings. It is submitted by the Counsel for both the parties that
probate proceedings are still pending.
Therefore, unless the probate proceedings are disposed of this
suit cannot be heard.
Let the suit go out of the list.
