The appeal has been filed challenging the judgment
and order of conviction passed by the learned Special
Judge, (POCSO) Court, Barasat, North 24 Parganas, on
02.06.2023 whereby learned Judge found the appellant
guilty of committing an offence under Section 8/12 of the
POCSO Act and sentenced to suffer rigorous
imprisonment for five years and to pay fine of Rs.
25000/-, in default, to suffer further imprisonment of six
months for the offence under section 8 of the POCSO Act
and he was also sentenced to rigorous imprisonment for
three years and to pay fine of Rs.10,000/-, in default, to
suffer further imprisonment for three months for the
offence under Section 12 of the POCSO Act. Both the
offences were directed to run concurrently.
I have heard learned counsel appearing on behalf of
the appellant and also perused the judgment.
Considering the scope of further evaluation of the
evidence, the appeal is admitted. Issue usual notices.
Trial Court Record be called for.
After arrival of the Lower Court Record, if it is
found, otherwise in order, the formal paper book shall be
prepared within six weeks thereafter.
Liberty is given to file bail application.
Realization of fine amount be stayed in the
meantime.
