The appeal has been filed challenging the judgment and order of acquittal dated 30.04.2011 passed by learned Chief Judicial Magistrate, Bankura in connection with G.R. Case No. 4 of 2005, whereby learned Chief Judicial Magistrate acquitted both the accused person from the charge under Section 325/326/506 of the Indian Penal Code.

Heard learned advocate appearing on behalf of the appellant.

I have gone through the judgment passed by the learned Judicial Magistrate and I find materials in favour of the admission of appeal.

The appeal is admitted. Issue usual notices. Trial Court Record be called for. After arrival of the Lower Court Record, if it is found, otherwise in order, the formal paper book shall be prepared within six weeks thereafter.

Realization of fine amount be stayed in the meantime.
