The petitioners are directed to serve a copy of this
revisional application upon the O.P. No.1 through the office
of the Learned Public Prosecutor, High Court, Calcutta and
upon the O.P. Nos.2, 3 and 4 by speed post with A/D and
file Affidavit-of-service on the next date so fixed for hearing.
Learned Advocate appearing for the
petitioner/defacto-complainant, submits that he approached
the Learned Sessions Court invoking the revisional
jurisdiction so that the evidence of P.W.2 can be recorded in
a proper manner.
However, the Learned Revisional Court was pleased
to not only dismiss the revisional application but imposed
cost of Rs.5,000/- upon the petitioner.
Having regard to the contention so advanced, I am
of the view that the revisional application is required to be
heard out on merits.

"Contested Application" on 29th of November, 2023.
Pending hearing of the revisional application, the
Judgment and Order dated 30.11.2022 passed by the
Learned Additional Sessions Judge, 5th Court, Howrah in
Criminal Revision No. 104 of 2019, be stayed till 11 th of
December, 2023.
Parties to act on a server copy of this order, duly
collected from the official website of the Hon'ble High Court,
Calcutta.
