Learned counsel for the petitioner reiterates his
contention that in view of the absence of any specific rule
or regulation under the Electricity Law, the mode
stipulated in the Motor Vehicles Act ought to be followed
for the purpose of deciding the quantum of compensation
payable to a victim of electrocution or like accidents.
Learned counsel appearing for the Distribution
Licensee hands over the extracts from the minutes of a
meeting of the Board of Directors, WBSEDCL, held on
February 20, 2017, which had apparently relied on a
previous judgment passed by a coordinate Bench of this
court and decided the quanta of compensation under
several heads.
Learned counsel for the WBSEDCL further submits
that the above direction was given by the Hon'ble Justice
Dipankar Datta (since elevated as the Chief Justice of the
Bombay High Court) in W.P. 34143(W) of 2014.
Arguments of the parties are substantially heard.
