The present appeal has been preferred challenging
the judgment and decree dated 30 th March, 2022 passed
by the learned Judge, 2nd Bench, City Civil Court at
Calcutta in Title Suit no.423 of 2012. In connection with
the appeal, an application for stay being CAN 1 of 2022
has been filed.
Heard Mr. Poddar, learned advocate appearing for
the appellants and Mr. Karmakar, learned advocate
appearing for the respondent.
It appears that the appellants are in occupation of
a room measuring about 150 sq.ft. and the same is
situated within the jurisdiction of Shyampukur Police
Station.
There shall be an unconditional stay of all further
proceedings in Title Execution Case No.24 of 2022 till
the returnable date.
On the returnable date, Mr. Poddar shall place
before this Court a bank draft of Rs. 50,000/- issued in
the name of the plaintiff/respondent.
List the matter for further consideration under the
heading "To Be Mentioned" in the daily supplementary
list of this court on 2nd August, 2022.
