The revisional application was filed in the year 2017
against the judgment and order dated 14.2.2017 passed by the
learned District & Sessions Judge, Bench-II City Sessions Court,
Calcutta in Criminal Appeal No.42 of 2016.
The appeal before the Sessions Court related to judgment
and order passed by the Learned Metropolitan Magistrate, 13 th
Court, Calcutta in connection with the proceedings under Section
138 of the Negotiable Instrument Act, wherein the Learned
Magistrate was pleased to sentence the present petitioner to suffer
simple imprisonment of one year and pay fine of Rs.4,00,000/-
(Four Lac) i.d. suffer simple imprisonment of three months more.
There has been no persuasion since 31.10.2017 before this court
and more than three and half years have passed.
Without going into the merits of the revisional application
I direct the learned Metropolitan Magistrate, 13 th Court, Calcutta to
take steps for execution of the judgment and order dated 28.3.2016
passed in complaint case no. C/16459 of 2009 as no interim order
has been passed by this court.
The department is directed to communicate this order
within a period of seven days to the Learned Metropolitan
Magistrate, 13th Court, Calcutta.
