The matter appeared in the warning list on November

29, 2022 with a clear indication that the matter would be transferred

to the daily cause list on December 5, 2022 before the regular

bench. Since then the matter is appearing in the list. The present

appeal is of the year 2007.

Today the appellant is not represented, nor any

accommodation is prayed for.

It appears from the record that a co-ordinate bench on

August 11, 2008 directed the matter to go out of the list with liberty

to mention after removal of defects and filing of required

documents. Even on that date none had appeared. In absence of the

certified copy of the judgment of the appellate court, the stamp

reporter was unable to submit report with regard to limitation.

Under such circumstances, we dismiss the appeal for

non-removal of defects. The appeal might have time barred by this

time.

There will be no order as to costs.
