This revisional application was preferred against the
Judgment and order dated 6.6.2012 passed by the Learned
Additional Sessions Judge, Fast Tract, 1st Court, Islampur, District Uttar Dinajpur in Criminal Revision No.10 of 2010.
The revisional Court decided the judgment and order dated 9.6.2010 passed by the Learned ACJM in M.R. Case No.32 of 2006 under Section 125 of the Code of Criminal Procedure. The Learned ACJM, Islampur by the order dated 9.6.2010 was pleased to award sum of Rs.400/- per month to the wife and Rs.400/- per month to the child aggregating to sum of Rs. 800/- per month. The said award was challenged by the present petitioner herein before the Ld. Sessions Court and the Ld. Sessions Court was pleased to affirm the judgment and order passed by the Ld. Magistrate and dismissed the revisional application.
Having regard to fact that no question of law is involved in the issue and there is no manifest error regarding the order passed by the Ld. Court below, I am of the view no interference is called for.
Accordingly, CRR 2869 is dismissed.
The wife/opposite party and the child would be entitled to recover any arrears by taking out appropriate application before the Ld. Magistrate.
Interim order, if any, stands vacated. All pending connected applications, if any, are consequently disposed of.
