submits that issue involved in this writ petition is

covered in his favour by a decision of the Hon'ble

Supreme Court in the case of Canon India Pvt. Ltd -

Vs- Commissioner of Customs reported in

2021(376) E.L.T. 3(S.C). But against that judgment

Department's review is pending and is likely to be

decided soon. Both the parties jointly pray for

adjournment of this matter.

Considering the prayer of the parties, list this

matter on 15th November, 2021 under the same

heading.
