Learned advocate for the petitioners prays for
necessary order may be passed directing the learned
Civil Additional District Judge, Chandernagore for
expeditious disposal of Title Appeal No. 158 of 2010.
He submits against the judgment and decree dated
31.05.2010 passed by the learned Civil Judge (Junior
Division), 2nd Court, Serampore, the petitioners have
preferred an appeal before the learned District Judge,
Chinsurah, Hooghly, but learned District Judge instead
of transferring the same to the court of Additional
District Judge, Serampore, transferred the same to the
court of Additional District, Chandernagore. Learned
Additional District Judge, Chandernagore by granting
adjournment is not hearing the appeal.
Since the petitioners have prayed for expeditious
hearing of Title Appeal No.158 of 2010, there is no
possibility of causing any prejudice to the opposite
parties.
Further, having regard to the nature of relief claimed,
I see no reason to put the opposite parties on notice.
Service of notice on the opposite parties is dispensed
with.
Accordingly, C.O.1984 of 2021 is disposed of with a
request to the learned Additional District Judge,
Chandernagore to dispose of Title Appeal No.158 of 2010
within a period of three months from the date of
communication of this order on priority basis as the
appeal is pending for more than eleven years.
There will be no order as to costs.
Urgent photostat certified copies of this order, if
applied for, be given to the parties upon compliance of
all requisite formalities.
