The second appeal tender is of year 1999.
Defects have been reported. Firstly, certified copies of
judgment and decree of trial Court were not filed.
Secondly, respondent nos.2 to 5 named in the memo do not
find place in certified copy of decree of lower appellate
Court. The third defect need not detain moving of the
appeal since the date of decree has to be the date of
judgment pronounced as provided in order XX rule 7 in
Code of Civil Procedure, 1908.
None appears on behalf of appellant. That is
understandable because perusal of the file reveals that
engaged learned advocate of appellant had since been
elevated to the Bench. In the circumstances, let
administrative notice be issued to appellant for making
alternative arrangement, thereafter taking steps to remove
the defects and to be represented on adjourned date. It is
made clear that in event of either of the above not complied
with, the appeal is likely to be dismissed.
