                         Mr. Partha Sarathi Bhattacharyya
                         Mr. Raju Bhattacharyya
                                                ... Appellants

By the order dated 18 th December, 2020, Mr. Deb

Roy, Learned Additional Government Pleader (AGP),

was heard and, on the terms as sought for by Learned

AGP, granted an opportunity to produce the original

records of selection connected to the promotional

exercise in issue in this appeal along with the

applicable rules and regulations in support of his

submissions. The appellants were represented by Mr.

Bhattacharyya, Learned Senior Counsel, then and are

                    also represented now.

Accordingly, by the order of December 18, 2020,

the matter was marked as "Appeals For Hearing

                    (Fixed)" today, i.e. January, 8, 2021.

However, none represents the respondents today.

Far from producing the records as allowed to be

produced by the order dated December 18, 2020

(supra), there is no whisper of any accommodation on

behalf of the respondents.

The attention of this Court is drawn to the fact

that the writ petition is of 2013. This intra-Court

appeal is of 2015 Therefore, a good seven and five

years respectively have intervened in between till this

day when the matter has been scheduled to be taken

up for final adjudication.

This Court is informed that the stand taken by

the respondents before the Hon'ble Single Bench

stands included in the Informal Paper Book(s) with

other documents in the shape of the Affidavit-in-

Opposition of the respondents.

In the absence of the promised assistance on

behalf of the State Respondents today, hearing of the

long pending matter stands now closed.

FMA 136 of 2019 with CAN 1 of 2015 stands

reserved for judgment.

All parties to act on a server copy of this order

duly collected from the official website of the Hon'ble

High Court, Calcutta.
