The matter has been extensively heard.
Learned advocate for the petitioners has relied
upon several judgements of Supreme Court and of
different High Courts. Section 33 has been inserted
after replacing Section 33 with effect from 19.12.1964.
In view of one Supreme Court judgment placed today,
reported in AIR 1964 SC 752, which was decided on 9 th
May, 1963, a question naturally arises whether the
present Section 33 including its sub-sections is pari
materia the earlier Section 33 before 19.12.1964.
I think on this point the party should come
prepared as one Supreme Court Judgment as aforesaid,
relied upon by the learned advocate for the petitioner.
For this purpose, the matter is adjourned.
By consent of the parties, the matter is adjourned
till 1st February, 2021 when it will be taken up at 2
p.m.
