Judgement Date : 26 February, 2021
26.02.2021.
Item no. 27.
Court No.13 sp W.P.A. No. 23818 of 2019 (Through Video Conference)
Sudha Singh Versus Union of India & Ors.
Mr. R. Kali ...For the petitioner.
Mr. Amal Kr. Sen, Mr. Sabyasachi Mondal ..For the WBSTC.
The petitioner claims pension on account of the
death of a retired employee, namely, Chandrama Singh
of the Kolkata Port Trust. The petitioner has produced
Health Certificate and a nomination form of the State
Bank of India in respect of a pension account being No.
248 signed by the said Chandrama Singh. The petitioner
has not been able to show the PPO Book of the said
Chandrama Singh nominating her as a beneficiary of
pension.
There is yet another discrepancy. The petitioner
further claims that Chandrama Singh and one
Biswanath Singh are the same person.
The Kolkata Port Trust considering the above
discrepancy have, by inter alia letter dated February 28,
2015 asked for documents in the nature of original
pension card of the ex-employee, marriage registration
certificate, nomination paper and any other document to
indicate that the deceased employee of Kolkata Port
Trust has effected any nomination in favour of the
petitioner and that the petitioner is the wife of the said
Chandrama Singh/Biswanath Singh. The petitioner has
not produced the same.
In those circumstances, no relief can be granted to
the petitioner in this writ application.
The writ petition is dismissed.
There shall be no order as to costs.
Urgent photostat certified copy of this judgment, if
applied for, be given to the parties upon compliance of all
formalities.
