             Ms. Pampa Dey (Dhabal)
                                            ...for the petitioner

             Mr. Subhabrata Dutta,
             Mr. Biswajit Dutta
                                                ...for the State

             Mr. Jaydip Banerjee
...for the private respondent nos.6 and 7

The writ petitioner complains that she has

been thrown out from her own house by the

daughter-in-law and granddaughter being

respondent nos. 6 and 7. The writ petitioner is a

widow and lives in a house that stands in her

name. She survives by the widow pension being

paid to her on account of her late husband's

employment.

The Officer-in-Charge, Indas Police Station

has submitted a report in the form of instructions

to the learned Government Pleader dated August

29, 2021. The same is taken on record.

It appears from the report that proceedings

under Section 107 of the Cr. P.C. has been drawn

up by the police against the private respondents

nos. 6 and 7 on the complaint of the petitioner.

Admittedly, there is serious discord between the

petitioner and the private respondentsd nos. 6 and

7.

This Court does not wish to enter into the

reason why the petitioner is now residing with her

daughter.

In view of the fact that the daughter-in-law

through counsel has submitted that she has never

objected or obstructed the petitioner from entering

into her own house. The petitioner shall therefore

return to her house immediately.

In the event of any obstruction or any

discord between the parties in future, the Officer-

in-Charge, Indas Police Station shall sternly warn

both parties and ensure that there is no breach of

peace.

With the aforesaid observations, the writ

petition is disposed of

There shall be no order as to costs.

Urgent photostat certified copy of this

judgment, if applied for, be given to the parties

upon compliance of all formalities.
